Nintendo has filed a lawsuit against accessory manufacturer Genki and its parent company Human Things over the early reveal of Nintendo Switch 2 mockups ahead of the console’s official announcement. The lawsuit, filed in California, accuses the company of trademark infringement, unfair competition, and false advertising.
According to Nintendo, in January 2025 at CES, Genki representatives — including CEO Edward Tsai — showcased 3D-printed mockups of the Switch 2, claiming they were based on a real device. Genki staff also gave several media interviews, revealing alleged confidential design details and functionality of the unannounced console.
Later, Genki displayed a video featuring renders of the Switch 2, including Nintendo trademarks like the console’s logo. Additionally, the company announced its own livestream styled after Nintendo Direct, scheduled just before Nintendo’s official Switch 2 presentation. Nintendo believes this was an attempt to mislead the public and suggest a partnership with the company.
If the court rules in Nintendo’s favor, the company seeks:
- Destruction of all Genki products related to the Switch and Switch 2,
- A permanent ban on using Nintendo trademarks,
- Compensation for damages, tripled due to the severity of the violations.
Human Things now has 30 days to respond to the allegations.
